1. Introduction

Welcome to Race Republic. These Terms of Use (“Terms”) govern your access to and use of our website, online store, and any related services, products, or content (“Services”).

By accessing or using our Services, you agree to these Terms in full. If you do not agree, please discontinue use immediately.

2. Eligibility

By using our Services, you confirm that:

You are at least 18 years old or have reached the legal age of majority in your jurisdiction; and

You have the legal capacity to enter into these Terms and agree to comply with them. 

3. Use of Our Services

You agree to use our Services only for lawful purposes and in accordance with these Terms.

We reserve the right to suspend or terminate your access if:

  • You violate these Terms or any applicable laws;
  • We suspect fraudulent, abusive, or harmful activity; or
  • Your actions may harm Race Republic’s operations or reputation.

4. Product Availability and Pricing

All product listings, pricing, and availability are subject to change without notice.

We reserve the right to limit quantities, cancel orders, or adjust prices at any time due to demand, supply changes, or pricing errors.

Prices shown exclude VAT (where applicable), shipping fees, duties, or taxes unless otherwise stated.

5. Order Processing, Billing & Payment

Orders are processed once full payment has been received, unless an approved payment plan or third-party finance option applies.

You must provide accurate billing, shipping, and contact details.

We reserve the right to cancel or hold any order that appears fraudulent, incomplete, or suspicious.

6. Shipping & Delivery

Shipping and processing timeframes are detailed in our Shipping Policy.

Delivery estimates at checkout refer to courier transit times and exclude processing or production times.

Race Republic is not liable for delays caused by courier companies, customs clearance, public holidays, or incorrect address details supplied by the customer.

International customers are responsible for all import duties, taxes, or clearance fees.

7. Returns & Refunds

Returns and exchanges are governed by our Returns & Refunds Policy.

Key terms include:

  • Return requests must be submitted within 7 days of delivery confirmation.
  • Items must be unused, undamaged, and in original packaging.
  • Refunds and exchanges are subject to inspection approval.
  • A 15% handling fee applies to all approved refunds or exchanges.
  • An additional 15% damage fee applies to items not returned in resellable condition.
  • Sale, custom, or personalized items are non-refundable.

Return requests made via email, WhatsApp, or chat will not be accepted,  all requests must be logged via the “Log a Return” form on our website.

8. Intellectual Property & Design Ownership

8.1 Intellectual Property Rights

All trademarks, product designs, logos, images, packaging, product renderings, and written or visual materials are the exclusive property of Race Republic.

These materials are protected under South African intellectual property law, including the Copyright Act 98 of 1978 and common-law protections against unlawful competition and passing off.

You may not:

  • Copy, reproduce, modify, or distribute any Race Republic content, design, or product.
  • Reverse-engineer, deconstruct, or create derivative works based on Race Republic products, packaging, or design concepts.
  • Use our logos, trade names, or creative works for any commercial, manufacturing, or promotional purpose without written consent.

Any unauthorized use constitutes an infringement of our rights and may result in legal action. 

8.2 Product Design Ownership & Restrictions

All Race Republic products, including their geometry, proportions, detailing, finishes, and overall visual design, are proprietary creations of Race Republic.

Purchasing a product gives you ownership of the physical item only.

It does not grant any license or rights to reproduce, scan, modify, or create derivative products, molds, or tools based on our designs.

This restriction applies to all individuals and entities, including but not limited to:

  • Automotive manufacturers, workshops, or installers;
  • Accessory companies or suppliers;
  • Resellers, agencies, or influencers representing a business or brand; and
  • Individuals purchasing for testing, duplication, or imitation purposes.

Any attempt to copy, replicate, or reverse-engineer Race Republic products, whether for personal, business, or resale use, will be treated as unlawful competition and may be actionable under South African law.

8.3 Commercial Resale & Distribution

Products purchased from our online store or authorized dealers are intended for personal use only, unless a written distribution or reseller agreement has been approved by Race Republic.

Unauthorized resale, re-branding, or reproduction of Race Republic products or packaging is prohibited.

We reserve the right to pursue legal or contractual remedies against any individual or entity engaged in unauthorized resale or imitation.

9. User Feedback & Submissions

By submitting reviews, feedback, or suggestions, you grant Race Republic a perpetual, royalty-free, worldwide license to use, reproduce, and publish such material for marketing or operational purposes.

10. Disclaimer & Limitation of Liability

All products and services are provided “as is” and without warranties of any kind, except where required by law.

Race Republic will not be held liable for direct or indirect damages arising from product misuse, incorrect installation, or issues with third-party couriers, payment processors, or service providers.
Customers are responsible for reviewing all installation guides, usage instructions, and compatibility notes before use.

11. Indemnification

You agree to indemnify and hold Race Republic harmless from any claim, liability, or expense (including legal fees) resulting from your misuse of our products, breach of these Terms, or violation of any law or third-party right.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa.

Any disputes will be subject to the exclusive jurisdiction of South African courts.

13. Changes to these Terms

We may revise these Terms from time to time. Updates will be posted on our website, and the “Last Updated” date will reflect the most recent version.

Your continued use of our Services after changes are posted constitutes acceptance of the updated Terms.
